Terms and Conditions of the Manoa App
Version dated 22 June 2026
These terms and conditions consist of three parts: Parts A (Terms of Use) and C (Final Provisions) apply to all users of the Manoa App. Part B (Special Terms and Conditions for Paid Access) applies additionally only to users who purchase paid access (self-paying users).
Part A – Terms of Use (for all users)
1 General
The Manoa App is provided by Pathmate Technologies AG (Pathmate), Josefstr. 219, 8005 Zurich, Switzerland, as the manufacturer and operator; it is your contractual partner. Pathmate Technologies GmbH, Glücksteinallee 25, 68163 Mannheim, Germany, is the distributor within the EU and the EU representative pursuant to Article 27 of the GDPR.
These terms and conditions govern the framework for the use of Manoa, liability issues and responsibilities. Details regarding data protection can be found in our privacy policy.
Use of Manoa and its content requires prior express acceptance of these terms and conditions, as well as acknowledgement of the privacy policy, and must take place upon registration. Furthermore, use requires confirmation that the user manual, which is made available to Manoa users within the app, has been read.
2 Description of Services and Intended Purpose
Manoa is a smartphone application (app) that offers personalised, evidence-based support for self-management to people with cardiovascular risk factors, with the aim of helping them to reduce or manage these factors. The precise intended purpose, instructions for use and any contraindications are set out in the user manual provided within the app. Manoa is classified as a Class IIa medical device.
The services provided by Manoa do not constitute medical advice and are not a substitute for a medical examination or treatment (see also Section 8).
Pathmate is entitled to further develop and adapt the functionality and design of Manoa. Users will be notified in advance, with reasonable notice, of any changes affecting the medical purpose or essential functions of the app.
3 Provision of the App and Registration
To use Manoa, you will need a participant code or must follow your health insurance provider’s registration process. You can obtain a participant code from one of our partner insurance providers or companies, or if your GP is participating in our study. The current list of partners and contact details can be found at https://manoa.app/partner.
If no participant code is available, you may purchase paid access; in this case, the Special Terms and Conditions in Part B apply in addition.
Access to Manoa is granted for a specific period in each case. The duration applicable to you depends on your health insurance scheme or the access you have purchased, and will be displayed in the app. Access ends automatically upon expiry; there is no automatic renewal or direct debit. We will inform you of options for continued use.
To use the service, you must download and successfully install the app from the Apple App Store or Google Play Store. When downloading Manoa, please observe the terms and conditions of the relevant store. To register, you will need an email address and must agree to receive emails from us relating to the service. Users must ensure that emails can be received at the email address provided and that unauthorised persons do not have access to it.
Conclusion of the contract: The availability of the app in the app stores does not constitute a binding offer. By registering and accepting these terms and conditions, you are making an offer to enter into the user agreement; the contract is concluded upon activation of the app or upon receipt of a corresponding confirmation. When purchasing a paid subscription, the sales contract is concluded with the relevant app store.
All natural persons who have reached the age of 18 (legal age of majority) and have full legal capacity are entitled to use Manoa. The user manual sets out further criteria for using the app which must be observed.
It is not technically possible to guarantee 100% availability of the app. In particular, maintenance work and events beyond Pathmate’s control may result in short-term disruptions or the app being temporarily unavailable. Users may report errors and faults in Manoa to manoa@pathmate.app .
4 Account and Login Details
Where login details (e.g. a password) are provided for use of the app, these must be kept confidential and protected from access by third parties. Please notify us immediately if you suspect unauthorised use of your account. Transferring the user account to third parties is not permitted.
The app provides an option to delete your user account. If a free user account remains unused for a period of more than 12 months, Pathmate reserves the right to delete the account; users will be informed of this in good time via their registered email address.
5 Rights of Use and Intellectual Property
The use of the information, software and documentation provided is subject to these terms and conditions. Separately agreed licence terms, e.g. when downloading software, take precedence over these terms and conditions.
Pathmate grants users a non-exclusive and non-transferable right to use the information, software and documentation made available in Manoa to the extent agreed or, if nothing has been agreed, in accordance with the purpose for which Pathmate has made them available.
Information, brand names, design and other content on Manoa are protected by copyright and other intellectual property rights. They may not be used or exploited in any way without Pathmate’s prior written consent; in particular, they may not be reproduced, edited, distributed or made available to third parties. Apart from the rights of use expressly granted herein, no further rights are granted to users, in particular with regard to the company name and industrial property rights (such as patents, utility models or trade marks).
Where users submit ideas and suggestions via the app, Pathmate may utilise these free of charge for the development, improvement and marketing of the products in its portfolio.
6 Users’ Obligations
Users undertake to provide all data in Manoa correctly, completely and truthfully.
In particular, when using Manoa, users must not
- use the app unlawfully or in an abusive manner;
- infringe industrial property rights, copyright or other property rights;
- transmit content containing viruses, so-called Trojan horses or other programmes that may damage software;
- manipulate the functions and content of Manoa or any data collected;
- circumvent security measures or disrupt the operation of the app (e.g. by overloading or interfering with systems);
- use automated methods to access the app (e.g. scraping, bots) or extract content automatically;
- create multiple accounts fraudulently or provide false personal details;
- reverse-engineer, decompile or disassemble the app, unless expressly permitted by law.
Pathmate may block access to Manoa at any time, in particular if the user breaches their obligations under these Terms and Conditions. In the event of any breaches, Pathmate reserves the right to claim compensation for all resulting damages and to take any necessary legal action.
Pathmate recommends that users implement the necessary security measures (e.g. password protection, up-to-date antivirus software) on their mobile devices. Users bear the risks arising from tampering with mobile devices, from the misuse of such devices or in connection with data transmission.
7 Hyperlinks
The Manoa app may contain hyperlinks to third-party websites. Pathmate accepts no liability for the content of these websites, as Pathmate is not responsible for the content and information provided there. Users access these websites at their own risk.
8 Use of Manoa – Medical Disclaimer
Manoa provides a range of information on health, exercise and similar topics for informational purposes only. This information is not a substitute for personal advice, care or treatment from healthcare professionals. Manoa does not alert users when a visit to a doctor is necessary. Please read the user manual for further information.
9 Availability, Changes and Updates to the App
Pathmate provides the app in accordance with the current state of the art. Updates may be released from time to time to improve performance and functionality, resolve security issues or reflect changes to operating systems. If an update is made available, use of the app may be restricted unless it is installed. Statutory obligations to provide updates (in particular Section 327f of the German Civil Code (BGB)) remain unaffected.
10 Exclusion of Liability
The information provided by Manoa is carefully checked and made available in accordance with the current state of knowledge.
Pathmate excludes – to the extent permitted by law – liability for material defects and defects of title. Furthermore, any liability on the part of Pathmate, in particular for consequential damages, is excluded, unless liability is mandatory under statutory provisions due to wilful misconduct, gross negligence, injury to life, limb or health, the assumption of a guarantee of quality, fraudulent concealment of a defect or a breach of fundamental contractual obligations. However, compensation for breach of essential contractual obligations is limited to the foreseeable damage typical for this type of contract, unless there is intent or gross negligence. Liability under the Product Liability Act remains unaffected.
Part B – Special Terms and Conditions for Paid Access (self-paying users only)
This Part applies in addition to Part A and applies only to users who purchase paid access to the Manoa app.
11 Scope of Application and Purchase of Paid Access
If one of our partner organisations or your health insurance provider does not provide you with a participant code, or if your health insurance provider does not support a registration process, you will need to purchase paid access. This applies in particular to the following cases:
Your health insurance covers Manoa, but insured persons must initially bear the costs themselves and submit the proof of purchase to their health insurance provider for reimbursement. You can obtain the necessary information from your insurance provider or at https://manoa.app/partner.
Your health insurance only covers Manoa for a limited period and you wish to continue using Manoa at your own expense. You can obtain information on extending your cover from your insurer or at https://manoa.app/partner.
- Your health insurance provider does not currently offer Manoa and you would like to purchase access yourself.
- Your health insurance provider is not yet one of our clients and does not support the registration process within the app.

12 Purchase, Prices and Processing
Paid access is purchased via the relevant app store. Users of Apple iOS devices can purchase access via the Apple App Store or within the app (in-app purchase); management and termination of access are subject to the relevant functions of the iOS device, and the entire transaction is handled by Apple. Users of Android devices purchase access via the Google Play Store; here too, the transaction is processed via the options provided by Google.
The applicable prices will be displayed to you in the relevant store prior to purchase. The terms and conditions of the relevant store also apply to the purchase and its processing.
13 Term and Termination
Once the usage period for the purchased access has expired, the access is not automatically renewed and does not need to be terminated. We will inform you of the options for continued use in each case; no automatic payment or debit will take place.
14 Right of Withdrawal
Paid access is purchased via the Apple App Store or the Google Play Store; the seller is the relevant store. Any right of withdrawal or refund is therefore governed by the terms and procedures of the respective store. For purchases made via the Apple App Store, Apple provides a withdrawal option via a support form within 14 days (support.apple.com/de-de/HT204084). In the Google Play Store, you can cancel your order within the first 48 hours of purchase; after that, please contact us directly (support.google.com/googleplay/answer/2479637). In the exceptional case where you enter into a contract directly with Pathmate, the statutory consumer withdrawal rights apply.
Part C – Final Provisions (for all)
15 Amendments to these Terms and Conditions
Pathmate may amend these terms and conditions with future effect, provided that this is necessary for a valid reason (e.g. a change in the legal situation, a ruling by a supreme court, or new technical or regulatory requirements) and that users are not unreasonably disadvantaged as a result. Users will be informed of any amendments in writing (e.g. by email) at least six weeks before they come into force. If the user does not object within this period, the amendment shall be deemed to have been accepted; users will be specifically informed in the notification of the significance of silence and of their right to object and to terminate the contract.
Users may send all communications to Pathmate by email or post. Pathmate may send communications to users via the email address specified in their user account.
16 Contracting Parties, Applicable Law and Place of Jurisdiction
The contracting party is Pathmate Technologies AG (Switzerland). Pathmate Technologies GmbH (Germany) is the distributor within the EU and a sales partner, but is not a contracting party to the users. The contract is governed by Swiss law, to the exclusion of conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country of your habitual residence remain unaffected; consumers with their habitual residence in Germany enjoy the protection of mandatory German consumer law. Furthermore, consumers may only be sued at their place of residence or bring legal proceedings there; otherwise, the place of jurisdiction is Zurich, provided that no mandatory consumer jurisdiction rules preclude this.
17 Consumer Dispute Resolution
Pathmate is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 of the German Consumer Dispute Resolution Act (VSBG)).
18 Miscellaneous Provisions
There are no oral or written ancillary agreements. Should individual provisions of these terms and conditions or of the concluded contract be or become invalid in whole or in part, the remainder of the contract shall remain valid; the invalid provision shall be replaced by the statutory provision.
The language of the contract is German. Pathmate is entitled to transfer rights and obligations arising from these terms and conditions, in whole or in part, to another company within the Pathmate Group; your rights shall not be affected thereby. Your claims arising from the contract may only be transferred to third parties with our prior consent.
You may access, save and print these terms and conditions at any time in the Manoa app and at https://manoa.app. The current version can also be found there.
